Four courts have arrest warrants in force against Ternera, whose extradition will be requested

The National Court has announced that there are 4 mandatory petitions of the central courts of instruction number 1, 2, 3 and 5 against Josu Ternera, arrested this Thursday in France, apparently, based on an arrest warrant issued by a French court to serve an 8-year sentence to which he was sentenced in Paris in 2017. In principle, he is expected to immediately enter a prison in the neighboring country to do so.

In all probability, Spain will request his extradition. The acting Interior Minister, Fernando Grande-Marlaska, recalled that the terrorist may be tried in Spain despite having other criminal cases in France since there is a "transitory delivery".

The first and most important requisition belongs to court 2, where an international arrest warrant (OID) and a European arrest warrant (OED) are in force for the attack on the barracks house in Zaragoza, the second with the most deadly victims of ETA after Hipercor.

In the court number, Ternera 1 has open summary for the murder in 1980 of Luis Maria Hergueta Guinea, manager of Michelin, who was shot in the neck when he returned to his home in Vitoria. For its part, court number 3 ordered on October 27, 2015, the search, detention and imprisonment of the ETA member now detained after being prosecuted for crimes against humanity in relation to crimes of murder.

Finally, the court number 5 has opened a summary against Urrutikoetxea for the crime of integration into a terrorist organization. The four requisitions have taken their respective OEDs that are in force. Some of the courts, pending the official confirmation of the arrest, have already ordered the translation of the OED into French.

Two convictions in France
Apart from his pending cases in Spain, Josu Ternera has pending at least two convictions for rebellion imposed by French courts, the last one in 2017, when he was sentenced to 8 years in prison for his membership of the ETA political apparatus between 2011 and 2013.

In particular, they considered proven that he was a member of the ETA leadership in that period that coincided with the time he remained in Norway before being expelled along with other ETA leaders, David Pla and Iratxe Sorzabal, in charge of the last negotiation attempt for the dissolution of the band.

To those 8 years of conviction in absentia that Ternera has pending in France must be added the 5 that in 2010 imposed on him by the Paris Correctional Court and that included the definitive exile from France. In that sentence, his son Egoitz Urrutikoetxea Laskibar was sentenced for four years, also considering him guilty of the crime of association of criminals for terrorist purposes because he belonged to ETA. .
