Military accused of killing Madeiran command meets judgment on 9 March in Sintra

A Comandos military officer accused of killing the Madeiran Luís Teles with a G-3 shotgun, at the Carregueira Barracks, in September 2018, knows the ruling on 9 March at the Sintra Court, a judicial source told Lusa today.

The panel of judges, chaired by Paulo Almeida Cunha, marked the reading of the judgment at 13:45, after the final allegations, made on February 21, during which the public prosecutor requested that the defendant be sentenced to a sentence between 10 and 12 years in prison for simple homicide and not for qualified homicide, a crime for which he is accused.

The lawyer Paulo Mendes Santos defended, for his part, the acquittal of his constituent.

In the first trial session, which took place on December 5, 2019, Deisom Camará, 22 years old and in preventive detention in Tomar since November 30, 2018, denied the crime, claiming that the victim provided the weapon and committed suicide.

The prosecution of the Public Ministry (MP), to which Lusa had access, refers that Deisom Camará, accused of the crimes of qualified homicide and possession of a prohibited weapon, knew the victim Luís Teles Lima (belonging to the 126th Command Course) since the 127th Command Course ended in November 2016.

Arguado and victim, both with the rank of soldier, were later on a mission to the Central African Republic (CAR) to join the second National Detached Force inserted in MINUSCA – United Nations Integrated Multidimensional Mission for Stabilization in the Central African Republic – in Bangui, between September 4, 2017 and March 5, 2018.

After returning from the mission, the victim joined the 2nd Companhia de Comandos, where he stayed until September 2018, the month he passed to the Training Company, with the function of assisting in training, specifically in the combat shooting part .

On November 28, 2018, the day the defendant was arrested, the authorities found in a box in a closet in his room, in Agualva, in the municipality of Sintra (district of Lisbon), “four 7.62 mm (mm) real ammunition , from the same batch of ammunition that soldier Teles killed ”, 10 rounds of ammunition, a live ammunition of another caliber, an active and unexploded instruction grenade, and a 60 mm mortar shell.

The indictment indicates that at 6:23 pm on September 21, 2018, soldier Luís Lima went “in a relaxed way to the guardhouse to support the magazine, where Deisom Camará was on duty”, and both had a conversation “of a non- concretely determined ”.

Considering the functions he was performing, the defendant had a G-3 automatic rifle, with a magazine loaded with 16 live ammunition and a salvo, with a 7.62 mm caliber.

Between 18:16 and 18:48, the victim and his best friend, also in the military, exchanged written messages through the ‘WhatsApp’ application, “always relaxed and in a good mood about the future, and displaying in various messages ‘laugh / laugh’ emojis ”.

“Between 6:48 pm and 6:56 pm, for reasons not ascertained, the defendant Deisom Camará wielded the automatic rifle G-3 that was assigned to him due to the sentry service to the house of the warehouse he was executing, leaning against it to the victim’s chest, with soldier Teles Lima already outside the warehouse. In a continuous act, the defendant fired the weapon he wielded, having hit the victim in the left pectoral region, which resulted in his death ”, describes the accusation.
