However, the rented car was later handed over to an individual with the initials IH, who also prepared fake KTP and KK cards in the name of AS. Subsequently, the car was sold to RH for IDR 23 million, who then sold it to a Navy officer with the initials SY. The car changed hands once more, being sold to AA, another Navy officer, for IDR 40 million.

Currently, four officers from Cinangka Police Station, including the head of the station, are being investigated by the Cilegon Regional Police over reports from the victim’s family.

In a separate statement, Navy Chief Laksdya TNI Denih Hendrata confirmed that three Navy personnel are involved in the incident. The personnel, initially reported to have been beaten at the toll road rest area, are now suspected to be connected to the shooting incident.

Navy Chief Denih also revealed that the incident stemmed from a dispute over the sale of a car, involving multiple transactions and fake documents. The Navy is cooperating with the Banten Police to investigate the case.

Meanwhile, police have arrested Ajat Supriatna and another individual in connection with the alleged theft of the rental car. They have been named suspects in the case. The investigation has identified two clusters of perpetrators: one involved in the car theft, and another connected to the shooting of the rental boss.

According to the Criminal Code Book of Indonesian Criminal Law (KUHP), there are several conditions that can decrease a defendant’s punishment. However, can politeness be one of these factors?

The idea of politeness influencing sentencing dates back to a Supreme Court decision in 2006, which has since been upheld in various subsequent rulings, creating a strong judicial precedent.

In the spirit of transparency, the following Supreme Court rulings have set this precedent:

  1. Supreme Court Decision No. 572 K/PID/2006:

    • Defendant displayed politeness during the trial
    • Defendant admitted their actions truthfully
    • Defendant had no prior convictions
    • Defendant expressed remorse for their actions
  2. Supreme Court Decision No. 2658 K/PID.SUS/201:
    • Defendant had no prior convictions

Additionally, Article 335(a) KUHP also cites:

The Independentunicipal Corruption Eradication Commission (Korini), Jakarta, has named Iwan Henry Wardhana, the former head of the Jakarta Culture Agency, and two others as suspects in a corruption case involving the embezzlement of government funds. The two other suspects are MFM, the acting head of the utilization division, and GAR, a private individual.

"The three suspects are alleged to have conspired to use ghost cultural centers to inflated expense reports for art and culture events, allowing GAR to siphon off funds into their personal accounts," said Syahron Hasibuan, head of the Public Relations Unit of Korini, Jakarta.

In this case, investigators accuse the suspects of violating Articles 2 and 3 of the Corruption Eradication Law (UU Tipikor), read together with Articles 18 and 55 of the Criminal Code (KUHP), and Article 64 of the Criminal Code. MFM and GAR have been taken into custody for 20 days, while Iwan Henry Wardhana’s whereabouts are yet to be determined.

Prior to this, Governor Teguh Setyabudi had earlier revoked Wardhana’s appointment as head of the Jakarta Culture Agency pending the outcome of the corruption investigation. "We have already arrested two people, with one still at large. I urge him to surrender to the nearest police station immediately," said Bogor Police Chief AKBP Rio Wahyu Anggoro on Thursday, December 26.

Rio revealed that the police are aware of the suspect’s vehicle and are closing in on his location.

"The two have been named as suspects. They face a maximum penalty of 5 years imprisonment under Articles 170 and 335 of the Criminal Code," Rio said.

Jakarta, Dec 27 (ANTARA) – A panel of judges at the Jakarta Corruption Court (Tipikor) sentenced three private smelter owners and a broker to varying terms of imprisonment for their roles in a Rp 300 trillion state loss corruption case involving illegal timah management.

Sentences Announced on Friday

The sentencing hearing was held at the Jakarta Corruption Court on Friday (Dec 27). The three private smelter owners are Tamron alias Aon, beneficial owner of CV Venus Inti Perkasa and PT Menara Cipta Mulia, Achmad Albani, general manager of CV Venus Inti Perkasa and PT Menara Cipta Mulia, and Hasan Tjie, director of CV Venus Inti Perkasa. The broker involved is Kwan Yung alias Buyung.

Tamron Sentenced to 8 Years

Tamron was sentenced to 8 years in prison and a Rp 1 billion fine for his role in corruption and money laundering. The judge ordered that if the fine is not paid, it would be replaced by an additional 1-year imprisonment.

Tamron was also ordered to pay Rp 3.538.932.640.663 (Rp 3.5 trillion) in reparations. If Tamron is unable to pay, he will serve an additional 5-year prison sentence.

The judge ruled that evidence seized would be considered as part of the reparations payment. If the seized evidence is more or less than the required reparations, it will be returned or additional jail time will be served, respectively.

Tamron was found guilty of violating Article 2 of the Anti-Corruption Law (UU Tipikor), in conjunction with Article 18 of the same law, Article 55 paragraph (1) point 1 of the Criminal Code (KUHP), and Article 3 or 4 of the Law on the Prevention and Eradication of the Laundering of Proceeds from Crime (UU P3P).

Albani, Tjie, and Buyung Sentenced to 5 Years

Achmad Albani, Hasan Tjie, and Kwan Yung alias Buyung were each sentenced to 5 years in prison and a Rp 750 million fine, with an alternative sentence of 6 months of imprisonment if the fine cannot be paid. The judge ruled that Albani, Tjie, and Buyung had violated Article 2 paragraph 1 or Article 3, in conjunction with Article 18 of the Anti-Corruption Law, in conjunction with Article 55 paragraph (1) point 1 of the Criminal Code.

Sentences Lighter than Prosecution’s Demand

The sentences were lighter than the prosecution’s demands. Tamron was originally charged with 14 years in prison, a Rp 1 billion fine, and Rp 3.6 trillion in reparations, with an alternative sentence of 8 years in prison.

Meanwhile, Albani, Tjie, and Buyung were charged with 8 years in prison and a Rp 750 million fine, with an alternative sentence of 6 months in prison.

Corruption Timeline

The prosecution accused the defendants, along with other suspects, of running a long-standing corruption scheme involving illegal timah starting in 2004. Tamron, Albani, Tjie, and Buyung were allegedly involved in purchasing and collecting illegal timah from miners operating outside their concessions, then collaborating with PT Timah, a state-owned enterprise, for processing without conducting feasibility studies, leading to inflated production costs. The heinous crime has left Palembang residents in shock and authorities pushing for the maximum penalty.

Rika’s brutal act unfolded on the afternoon of December 18, 2024, at a residence in Kelurahiran 5 Ulu, Seberang Ulu I, Palembang. She challenged AN to a drinking contest, promising Rp 300,000 to the winner who could down a 600 ml bottle of ‘jamu’ without vomiting. AN, unaware of the deadly secret, took the bet and consumed the poisoned drink.

The Aftermath

AN initially struggled to keep down the drink, hopeful of winning the cash prize. However, she soon stumbled to the bathroom, heaved, and collapsed, succumbing to the toxic effects of the potas. Rika callously left AN to die and, once satisfied that her victim was lifeless, dragged the body to hide it behind a wardrobe.

AN’s mother returned home from her Religious lesson around 3:30 PM and inquired about her daughter’s whereabouts. Rika feigned ignorance and left the house. She then messaged her husband, YA, revealing the drinking contest and mentioning AN was behind the wardrobe.

Arrest and Charges

Rika attempted to flee to Lampung but was apprehended by police in Kelurahan 13 Ilir, Palembang. She now faces an uphill battle to evade a penalty of up to 15 years in prison or even death, charged under the Child Protection Law (UU Perlindungan Anak), Article 338 and/or 340 of the Criminal Code (KUHP) on Premeditated Murder.

Motive: A Sinister Case of Revenge

In custody, Rika confessed to police that she harbored grudge against AN, blaming her for frequent taunts about her newborn baby. "The suspect had long been annoyed by the victim, who often ridiculed her about her baby," admitted Head of Palembang Metro Police, Kombes Harryo Sugihhartono.

Investigators procured evidence through AN’s phone and computer logs, confirming Rika had ordered the potassium carbonate online on December 2, 2024. Police believe Rika mixed the entire package into the 600 ml water bottle AN drank.
