Courtroom Appearance and Estranged Spouses Maintain Distance
Kim Zolciak and Kroy Biermann kept their distance during a court appearance as their 15-year-old son, Kroy “KJ” Biermann Jr., sought release on bond. The former Real Housewives of Atlanta stars appeared separately as their son sought bond, with Kim appearing serious during the court appearance and Kroy keeping a low profile as the former spouses remained apart while proceedings unfolded.
Following the hearing, Kim Zolciak and her older daughter, Brielle Biermann, walked out of the Georgia courthouse in matching black dresses as members of the media peppered them with questions about the case. The two quietly climbed into a waiting black SUV, then drove off with several officers providing them protection as they navigated a media scrum.
Felony Indictment and Unsealed Juvenile Records
KJ has been held at Atlanta’s Metro Regional Youth Detention Center since his August 17 arrest. A Georgia grand jury indicted him on seven felony counts related to alleged sexual misconduct and false imprisonment, with the alleged incident occurring at Lifetime Fitness. The minor female victim reported an aggravated sexual battery and aggravated sodomy.
Records unsealed in court revealed a previous sexual battery case from April 2023 involving a victim around the same age as him at the time. Biermann was on probation from those charges and has been under court supervision for that charge since October 2025, though that case was not made public before because it was in juvenile court.
During the proceedings, Deputy District Attorney Caitlin McGillicuddy claimed investigators found videos on KJ’s cell phone which they say depict the 15-year-old having penetrative sex with a relative under 12 years old. McGillicuddy claimed there were multiple encounters
on video found on KJ’s phone and that KJ uses predatory, derogatory
language toward the alleged victim in the videos. A judge did not make a determination on bond during the hearing, with a decision expected later in the day or next week.
Defense Strategy and Public Statements from Family
The defense filed a request on September 8 asking the court to transfer the case to juvenile court. His attorneys filed a motion for him to transfer to juvenile court and for confidentiality proceedings,
with the defense arguing that KJ was 14 when the alleged incident occurred and maintaining that the teenager should not face the adult system. The defense argued for bond to be set, with Biermann continuing school online and wearing an ankle monitor, while the prosecution asked for no bond, saying he should not be around people under the age of 18.
His attorney, Jason Sheffield, has said KJ denies the allegations, and the defense plans to enter not guilty pleas during his October 14 arraignment.
“The allegations being made against my son are nothing short of reckless and deeply troubling. He categorically denies ever being involved with this woman or engaging in the conduct she has alleged.”

“It is difficult to comprehend that a 14- or 15-year-old child can be held in detention for a month or longer simply waiting for a bond hearing, but that detention is a direct consequence of the detective’s decision to arrest him on charges of this magnitude.”
