California has enacted a new legislation, Senate Bill 1271 (SB 1271), that sets clear boundaries for electric bikes (e-bikes) allowing only those meeting specific power and speed limits to circulate legally on roads and bike lanes. This bill, effective January 1, 2025, aims to distinguish e-bikes from mopeds and other motorized two-wheelers.

Key Points of SB 1271:

  1. Speed and Power Limits: E-bikes must not exceed 32 km/h (20 mph) using just the throttle and must have motors not exceeding 750 watts. E-bikes going faster or with more powerful motors will be classified differently, requiring adherence to stricter regulations akin to motorcycles.

  2. Operable Pedals: All e-bikes must have functional pedals to maintain their classification. Removing pedals disqualifies a vehicle as an e-bike under this legislation.

  3. Modification Restrictions: Even if an e-bike is initially configured within the speed and power limits, it will lose its e-bike status if it can be modified to exceed these parameters. The term "continuous power" has been removed, meaning motors that temporarily surpass the 750-watt threshold will fall outside the permissible classification.

  4. Aftermarket Modifications: Any e-bike altered to exceed the specified limits post-manufacturing will lose its legal e-bike status, including DIY projects. This regulation applies to all customizations, from power and speed alterations to pedal removal.

Impact on E-Bike Market:

The new law affects popular e-bike models from brands like Sur Ron and Talaria, which resemble e-bikes but perform similar to motorcycles. These models can no longer circulate on public roads as e-bikes. The regulation may significantly impact sales and marketing strategies of these vehicles, with some manufacturers planning to adapt products or redesign models to fit moped categories.

Entities that do not comply with the new standards must register their vehicles as motorcycles or mopeds, adhering to additional requirements like licenses, insurance, and safety regulations.
