The U.S. Prosecutors acknowledged that Interior Department documents proved damage to the Lincoln Memorial Reflecting Pool stemmed from a botched contractor installation rather than vandalism.
Federal prosecutors have officially abandoned their criminal case against David “Davey” Hearn, a three-time Olympian who faced charges connected to damage at the Lincoln Memorial Reflecting Pool. Attorney’s Office for the District of Columbia moved to dismiss the indictment, conceding that investigators obtained information that severely undermined the evidentiary basis for the charges.
The sudden reversal marks an abrupt halt to a prosecution brought under the office headed by Jeanine Pirro. Authorities had previously accused Hearn of destruction of property, alleging he caused more than $1,000 worth of damage to the newly renovated water feature when he placed his hands in the water. Hearn maintained his innocence throughout the ordeal, pleading not guilty and insisting the pool’s condition remained identical before and after his arrival.
Interior Department Records Reveal Botched Contractor Work
The collapse of the government’s case began when the Interior Department supplied new records to federal prosecutors. According to the court filings, those documents established that the widespread deterioration plaguing the reflecting pool in June 2026 resulted from flawed installation by the contractor, Atlantic Industrial Coatings.
The Justice Department admitted that officials first became aware of the installation failure only after reviewing the newly surfaced records. Prosecutors stated in their filing that it is difficult to attribute the widespread damage to the Reflecting Pool to vandalism, let alone to establish that fact beyond a reasonable doubt
.
Attorney’s Office also moved to dismiss at least one of the three remaining misdemeanor cases linked to the pool.
Defense Attorney Demands Federal Apology
Legal representation for the former athlete sharply criticized the government’s initial handling of the investigation, pointing to a rush to judgment that unfairly targeted a private citizen.
“The Government’s case against Davey Hearn should never have been brought. Its dismissal today does not erase the abuse of government power in arresting and charging a patriotic American. The government’s approach was ready, shoot, aim. The federal government owes Mr. Hearn an apology.”
