Harvey Moeis, husband of Sandra Dewi, received a reduced sentence of 6.5 years instead of the prosecution’s requested 12 years for his role in a corruption case involving the management of tin commodity trading. The verdict, announced by the presiding judge, Eko Aryanto, took into account Harvey’s model behavior throughout the trial and his family responsibilities.
The reduced sentence was further supported by two other factors. Firstly, Harvey, a businessman by profession, had no prior criminal record. Secondly, his actions were deemed to have occurred while the state was activelylations against corruption.
In addition to the imprisonment, Harvey was fined Rp210 billion, payable within one month after the court’s decision becomes final. If unpaid, his assets will be seized and auctioned. If Harvey fails to pay due to insufficient assets, he will serve an additional two years in prison.
What Else Can Affect a Convict’s Sentence?
Beyond Harvey’s case, there are several factors that can potentially reduce or increase a defendant’s sentence according to Indonesia’s Criminal Code (Kitab Undang-Undang Hukum Pidana – KUHP):

Attempted Crime (Pelaku Percobaan): Those caught in the act of committing a crime but fail to complete it, or those who start but do not finish their crime, may face a reduced sentence. The reduction can be up to one-third of the maximum penalty for the crime, or a maximum of 15 years in prison if the crime carries a penalty of life imprisonment or death (Pasal 53).

Aiding and Abetting Crime (Pelaku Pembantu Tindak Pidana): Those who knowingly assist in the commission of a crime can also face a reduced sentence. The reduction can be up to one-third of the maximum penalty for the crime, or a maximum of 15 years in prison if the crime carries a penalty of life imprisonment or death (Pasal 56).

However, if she does so out of fear of societal backlash, her sentence can be halved (Pasal 308).
These regulations demonstrate that Indonesian law considers not only the severity of the crime but also the circumstances surrounding it and the personal background of the defendant.
