The Kuruman Regional Court sentenced 73-year-old Nkagisang “Moepadikhi” Setha to 20 years of direct imprisonment for the rape of three children, aged five to seven. According to the National Prosecuting Authority (NPA), Setha lured the victims from a street to his home with sweets in June 2022 before locking the door and assaulting them.

Details of the June 2022 Assault and Arrest

Evidence presented in court showed that the children were playing in the street when Setha lured them inside his residence under the pretense of giving them sweets. Once inside, the children were locked in and raped.

NPA regional spokesperson Mojalefa Senokoatsane stated that the abuse was interrupted when an unidentified man forced open the door, allowing the children to escape. The victims later told a younger family member, who then informed family elders.

Did You Know? The court ordered that Setha’s name be entered into the National Register for Sex Offenders and declared him unfit to work with children or possess a firearm.

Following the report to police, Setha was arrested and prosecuted. The court ordered that the sentences for the three counts of rape run concurrently, resulting in an effective 20-year term.

Legal Arguments and Victim Support

Prosecutor Kekeletso Lekota urged the court to impose a sentence reflecting the gravity of the crimes against vulnerable children. The state argued that a substantial custodial sentence was necessary to protect children, deter other offenders, and uphold the dignity of the victims, according to Senokoatsane.

The Kuruman Thuthuzela Care Centre (TCC) provided the victims with specialized medical, psychosocial, and court support services. Senokoatsane noted that these interventions contributed significantly to the victims’ recovery and the successful prosecution of the case.

Expert Insight: This case highlights the critical role of specialized support centers like the TCC in bridging the gap between trauma and testimony. When victims receive immediate psychosocial care, it often increases the likelihood of successful prosecution in gender-based violence cases.

NPA Stance on Child Protection

Senokoatsane described the sentence as a “clear affirmation” that courts will severely punish those who prey on children. He stated the result demonstrates the commitment of the NPA and its partners to combat gender-based violence and femicide.

The NPA further commended the courage of the young victims and the work of the investigating and prosecution teams in securing the conviction.
