Charges Filed in Fatal Collision

Mr. Ball, who has been suspended from duty, has been charged with dangerous driving causing the death of Niall McEneaney on March 17, 2024. He also faces a charge of failing to remain at the scene of the collision.

According to court documents, the dangerous driving charge alleges that Mr. Ball “drove a vehicle in a manner including speed, which having regard to all the circumstances of the case, was dangerous to the public, thereby causing the death of another person, namely Niall McEneaney,” in violation of Sections 53(1) and 53(2) of the Road Traffic Act.

The second charge states that Mr. Ball failed to remain at the scene, “whilst knowing that Niall McEneaney was dead” or “being reckless as to whether the injury so caused resulted in his death, and did so with intent to escape civil or criminal liability,” contrary to Sections 106 (1) (B) and 106 (3)(AB) of the Road Traffic Act 2006.

Investigation and Prosecution

The Director of Public Prosecutions directed the charges following an investigation by Fiosru, formerly the Garda Ombudsman Commission (GSOC). Mr. Ball was initially arrested in April of this year in connection with the investigation.

The case was adjourned until a date in January following the initial court appearance.
