Minister of Finance Facing Controversy Over Campaign Funds Disbursement
In a recent episode of "Guest of the Day," Bogdan Rymanowski interviewed constitutional law expert Prof. Ryszard Piotrowski about the decision of the State Election Commission (PKW) to accept the financial report of PiS‘ 2023 election campaign. The dispute now lies in whether the Minister of Finance should disburse millions of zlotys to the formation.
Prof. Piotrowski stressed that the matter is clear-cut, with the Minister of Finance (Andrzej Domański) obliged to follow the requirements of the Electoral Code, particularly Article 150, Section 6, which stipulates the transfer of funds.
Deadline Looms for Minister’s Payout
Prof. Piotrowski pointed out that the payment should have occurred within nine months of the election date, a period that has long passed. He emphasized the urgency, given the impending presidential campaign and the need for opposition parties to receive their fair share. The expert also noted that, as a member of the government, the Minister must represent its stance, as outlined in the Cabinet’s December 18 ruling against the adverse effects of the constitutional crisis on the judiciary.
The Minister, however, is bound by the Electoral Code, which Prof. Piotrowski described as "holy law" in this context, until a new act is passed.
Possible Consequences for Tusk
When asked about Prof. Ewa Lętowska’s suggestion that the ruling could serve as a pretext for withholding funds, Prof. Piotrowski countered that the minister is ultimately bound by the constitution and laws. He warned that failure to disburse the funds could lead to accountability, including for Prime Minister Donald Tusk.
Protecting the Rule of Law
Prof. Piotrowski cautioned against prioritizing politics over law, stating that doing so would be detrimental to Poland’s rule of law and order. He expressed concern that both the previous and current governments have taken actions contrary to the law, questioning the point of swearing to uphold the constitution.
