Lawyer: NSW Woman Ignorant of Alleged Bikie Smuggling Plot

A 40-year-old New South Wales woman, Fatma Skaf, has been released on a $100,000 surety after being charged with attempted people smuggling in Western Australia. Her arrest occurred Monday morning while she was driving between Exmouth and Karratha, a region roughly 1,000km north of Perth.

The charges follow a high-stakes operation by Western Australia’s Joint Organised Crime Taskforce, which intercepted a luxury yacht 50km off the coast of Exmouth. On board were Queensland fugitive Dylan Cvek and two other Queenslanders, Cass Williams and Jessica Beckett. While Mr. Cvek has since been extradited to Queensland to face multiple charges, the incident marks the first time individuals have been charged with this specific offence in Western Australia.

Did You Know?

While authorities initially suspected the yacht was bound for Indonesia, the court heard that Thailand was the alleged final destination for the group.

The Prosecution’s Allegations

Prosecutors allege that Ms. Skaf drove Mr. Cvek 550km from Karratha to a boat ramp in Exmouth during the early hours of the morning. During a hearing at the Karratha Magistrate’s Court, it was stated that Ms. Skaf initially told police she was in the area for sightseeing before later claiming she had been punched in the sternum and taken to Exmouth under duress.

The prosecution is currently in the early stages of gathering evidence, which includes reviewing a laptop found in Ms. Skaf’s vehicle—believed to belong to Mr. Cvek—and the defendant’s mobile phone.

Expert Insight:

The magistrate’s decision to grant bail reflects a careful balancing of public safety against the strength of the current evidence. By emphasizing the defendant’s lack of a criminal record and the preliminary nature of the investigation, the court has set a high financial threshold for her release, which serves as a significant deterrent against flight risk.

Defense and Conditions

Defense counsel Adam Oswald argued that Ms. Skaf was unaware of the plot to spirit Mr. Cvek out of the country or his status as a fugitive. Mr. Oswald maintained that his client had traveled to Western Australia under the impression she would be embarking on an all-expenses-paid holiday and pursuing an “intimate relationship” with the man.

Magistrate Cillian Stockdale, in granting bail, noted that the case against Ms. Skaf could not be described as “strong” at this stage. However, strict conditions apply: she is prohibited from contacting her co-accused, must remain in Australia, and is barred from coming within 1km of any international airport unless transiting to her home in New South Wales.

What Happens Next

The legal proceedings will move forward in two stages. Ms. Williams and Ms. Beckett are scheduled to appear before the Carnarvon Magistrate’s Court on June 15. Ms. Skaf is expected to return to court in Perth on July 10. Meanwhile, the Joint Organised Crime Taskforce continues its investigation into the broader syndicate allegedly responsible for the scheme.

Frequently Asked Questions

What was the nature of the alleged smuggling plot?
Prosecutors allege that Ms. Skaf assisted in transporting a fugitive, Dylan Cvek, to a luxury yacht off the coast of Exmouth with the intention of smuggling him out of the country to Thailand.

Why was Ms. Skaf released on bail?
Magistrate Cillian Stockdale granted bail based on the defendant’s lack of a criminal record and the observation that, based on current evidence, the case against her is not strong. She was required to provide a $100,000 surety.

What are the restrictions on Ms. Skaf while she is on bail?
She cannot contact her co-accused, must report to Bankstown Police Station twice a week, and is restricted from approaching within 1km of an international airport, except when returning to New South Wales.

How do you think the ongoing investigation into the criminal syndicate will impact the cases of the individual defendants?
