Eliminating the presidential threshold may open the door to as many as 30 presidential and vice-presidential pairs, says MK deputy chief Saldi Isra.

The presidential threshold was initially introduced as an additional regulation to strengthen the presidential system. It first appeared in the 2003 Law on the Election of the President and Vice President, with a threshold of 15% of DPR seats or 20% of national valid votes. This was subsequently raised to 25% of DPR seats or 20% of national valid votes in the 2008 Law. The current threshold was set in the 2017 Election Law.

With the MK’s decision, political parties and coalitions can now nominate more diverse presidential candidates, fostering greater choice and inclusivity in Indonesian democracy. This ruling is expected to shape the presidential landscape in the upcoming 2029 election.

According to the MK, AI-manipulated photos or images cannot be excessively used in election campaign paraphernalia for parliamentary and presidential elections.

The petitioner initially sought to amend Article 1 point 35 to read: "Campaigning in Elections is an activity carried out by Election Participants or their authorized parties to persuade the public with their vision, mission, programs, and/or ‘self-image’ (citra diri) in the form of candidate numbers, photos/images, voice clips, combinations of photos/images and voice clips, or any recent manipulated versions, provided that they do not use digital manipulation or AI technology, or at least require election participants to clearly state if the number, photo/image, or voice clip used is the result of digital manipulation or AI technology."

Advocated by Gugum Ridho Putra and the Advocates for Clean Elections (TAPP), the lawsuit was filed due to concern over potential misuse of AI in the 2024 election process.

This doesn’t seem like someone who ‘slapped’ Jokowi," Guntur quipped.

Guntur believes that Bahlil’s defense is just a public joke. "Bahlil’s illogical defense is similar to the illogical protests against Jokowi. They’re both just laughing stocks," he commented.

Guntur also stated that PDIP had always kept Jokowi in check, even when the third term talks were prevalent. "In 2022, when the third term talks were rampant, PDI Perjuangan was still very close to Jokowi. We made sure he didn’t overstep his bounds, like wanting to extend his term or run for a third term. Bahlil, at that time, wasn’t very close to Jokowi, but he tried to push the third term idea like a broker," Guntur revealed.

Meanwhile, Bahlil Lahadalia has refuted claims that he received orders from Jokowi regarding the third term issue. In a press conference, he announced that he was the first to suggest delaying the 2024 presidential election. Bahlil, however, reiterated that the idea did not come from the President.
