According to attorney Minola Sebayang, a parent’s financial independence does not legally eliminate their co-parent’s ongoing child support obligations or visitation rights. Speaking in Kuningan, Jakarta Selatan, Sebayang addressed statements regarding Sarwendah’s financial self-sufficiency and clarified the legal boundaries surrounding parental duties and child custody involving Ruben Onsu.
Financial Independence and Child Support Obligations
Financial self-sufficiency by one parent does not automatically dissolve the financial duties of the other, according to legal counsel Minola Sebayang. In a statement addressing recent claims regarding Sarwendah managing her own finances, Sebayang emphasized that determinations regarding financial support cannot be made unilaterally by just one parent.
“If misalnya dia juga mengatakan bahwa dia sudah mampu secara mandiri, tapi kan itu bukan berarti ayahnya tidak bisa memberikan nafkah,” Sebayang stated in Kuningan, Jakarta Selatan. He added that an individual parent cannot simply declare that financial support from the other party is no longer required due to personal capability.
Distinguishing Financial Support from Visitation Rights
Legal representatives emphasize that monetary child provisions and a parent’s right to spend time with their children are completely separate legal matters. Sebayang noted that Sarwendah’s financial independence should not be used as a justification to restrict Ruben Onsu’s role as a father.
“Bukan berarti karena dia sudah bisa mandiri untuk membiayai dan menafkahi anaknya, lalu itu menghilangkan hak Ruben untuk berkumpul dan bertemu sama anaknya,” Sebayang explained. He further cautioned against using the topic of financial contributions as a tool to monopolize child custody without proper involvement from both parents.
Current Status of Child Provision Arrangements
According to Sebayang, Ruben Onsu has not yet been able to disburse specific financial support payments because detailed breakdowns of the children’s exact needs have not been formally provided.
Sebayang urged that discussions regarding child provisions should not be conflated with custody disputes. He called for an end to public dramatics and requested that matters concerning financial contributions remain separate from parental visitation rights.
