In a significant step towards combating stunting, the Indonesian government has initiated a program offering free nutritious meals to pregnant women, lactating mothers, and young children aged 0-2 years. Speaking at the launch in Ciracas, Jakarta Timur, the Deputy Minister of National Development Planning, Isyana Bagoes Oka, emphasized the importance of this program in preventing stunting, particularly during the critically important first 1000 days of life.

First 1000 Days of Life

The 1000-day window refers to the period from the beginning of pregnancy until the child’s second birthday. According to Isyana, the countdown starts from the moment of conception, not just from the child’s birth. This phase is critical for a child’s growth and development, and providing nutritious meals to pregnant women, new mothers, and toddlers can significantly improve their chances of healthy growth.

Multi-Level Interventions

The program is currently being piloted in select locations across the country. Although it’s not yet as widespread as the school meals program, which reaches 190 points, the government aims to expand it. Isyana reassured that the Ministry of National Development Planning is coordinating with the National Nutrition Agency (Badan Gizi Nasional) and mobilizing its teams of family mentors to ensure the smooth implementation of the program.

Phaedra Laura, spokesperson for the Presidential Communication Office, confirmed that the initiative is currently offering weekly nutritious meals to eligible beneficiaries. However, President Prabowo’s vision is to expand this to daily meals.

Stunting, or impaired growth and development due to poor nutrition and repeated infection, is a serious issue in Indonesia. According to the latest data from the National Nutrition Agency, nearly 30% of Indonesian children under five are stunted. This new program is a testament to the government’s commitment to improving the nutritional status of its citizens and ensuring a healthier future for Indonesia.

Jakarta: The term ‘politeness‘ has recently sparked public curiosity, especially when it comes to the mitigation of sentences in several cases, even capturing the attention of supreme court officials. But where did this notion originate, and can politeness truly lessen a defendant’s punishment?

According to the Criminal Code Book of Indonesian Criminal Law (KUHP), there are several conditions that can decrease a defendant’s punishment. However, can politeness be one of these factors?

The idea of politeness influencing sentencing dates back to a Supreme Court decision in 2006, which has since been upheld in various subsequent rulings, creating a strong judicial precedent.

In the spirit of transparency, the following Supreme Court rulings have set this precedent:

  1. Supreme Court Decision No. 572 K/PID/2006:

    • Defendant displayed politeness during the trial
    • Defendant admitted their actions truthfully
    • Defendant had no prior convictions
    • Defendant expressed remorse for their actions
  2. Supreme Court Decision No. 2658 K/PID.SUS/201:
    • Defendant had no prior convictions
    • Defendant behaved politely during the trial

Additionally, Article 335(a) KUHP also cites:

  • Defendant had no prior convictions
  • Defendant admitted their actions truthfully and behaved politely throughout the trial
  • Defendant exhibited remorse

The Supreme Court’s official spokesperson, Yanto, clarified that the consideration of aggravating and mitigating circumstances is mandated by KUHP Article 197. However, the consideration of politeness as a mitigating factor is not explicitly mentioned in the KUHP, classifying it as a special consideration.

Yanto further explained that while politeness cannot be prescribed by law, it can be considered by judges, along with other extenuating circumstances, when making a ruling. For instance, a defendant who expresses remorse, assists victims, or demonstrates strong reformative potential may find that politeness and respect for the court process contribute favorably to their sentencing.

Ultimately, the application of politeness as a mitigating factor lies within the judge’s discretion, guided by their interpretation of the law and the facts presented in each case. The Indonesian legal system, much like many others, seeks fairness and legitimacy in its rulings, and the consideration of politeness is one aspect that may serve this purpose.

In an unexpected turn of events, members of the Capital Region’s Regional House of Representatives (DPRD) Commission E have expressed shock and concern over the provincial government’s (Pemprov) decision to bear the cost of BPJS Kesehatan premiums for Harvey Moeis and his wife, Sandra Dewi. The couple, who are considered capable of affording their own health insurance, have been receiving provincial subsidies since 2018.

Oman Rohman Rakinda, a member of the PAN party in DPRD Commission E, voiced his astonishment at the situation, "I’m surprised that the provincial government is paying for their BPJS premiums. People like Harvey Moeis should be paying for their own health insurance."

Rakinda stressed that the intended beneficiaries of such subsidies are those who genuinely need assistance, not the affluent. He urged the provincial government to conduct a thorough review and overhaul their database to ensure only the deserving receive aid.

Meanwhile, Abdul Aziz, an F-PKS member of the same commission, emphasized the need for transparency and accountability in the management of BPJS data. He echoed Rakinda’s sentiments, calling for an immediate review and cleanup of the beneficiary list.

Aziz stated, "BPJS data must be transparent and accountable to the public. We hope the provincial government will take swift action to address this issue and conduct a thorough audit of all beneficiary data."

Harvey Moeis and his wife’s BPJS premiums have been covered by the provincial government since 2018, with the couple reportedly unaware of this arrangement until recently. In response, Acting Governor Teguh Setyabudi acknowledged the issue and announced that the province is currently revising their records to remove those who are no longer eligible for subsidies.

The provincial government is also actively promoting independent BPJS registration and encouraging those who can afford it to opt for independent premiums. As part of these efforts, they are increasing public awareness about the distinction between JKN mandiri (independent) and JKN through PBI (subsidized) programs.
