Criminal Complaint Filed Against Students Over Threats of Gang Rape and Kidnapping

A criminal complaint has been filed against two 8th-grade students at Colegio Alerce in Puerto Montt, located in the Los Lagos region, following disturbing threats made against a teacher and the children of the school’s director.

According to information obtained by Radio Bío Bío, the threats were coordinated within a student WhatsApp group chat. The primary suspects are reportedly two minors, aged 14 and 15, who were allegedly encouraged by other students as young as 13.

Disturbing Communications

The contents of the group chat revealed a series of graphic and violent proposals. One student remarked on how easy it was to “mess with” the teacher, followed by another suggesting, “What if we rape her.” A female classmate responded, “Rape her all together then,” while another minor added that it was obvious the teacher “doesn’t get it at home.”

The threats extended beyond the teacher. Another student proposed kidnapping the children of the school director, suggesting a ransom of 10 million and the demand that students be allowed to use cell phones during class. Additional threats included burning down the educational establishment.

Impact on the Victim

The affected teacher became aware of these messages on April 22 during her workday. In response, she filed a criminal complaint against those involved and requested protection measures.

The teacher is currently on medical leave. Her lawyer, Mauricio Sáez, confirmed that she is “very scared” and noted that she currently has no protection measures in place, remaining only on medical leave at home.

Sáez explained that the decision to pursue criminal action was motivated in part because the “Aula Segura” protocol did not apply to this specific type of incident, leading the legal team to recommend maintaining her medical leave and seeking other legal avenues.

Institutional Response and Next Steps

Faustino Villagra, the acting director of the DAEM (Municipal Education Department), stated that a coexistence protocol has been implemented. He confirmed that the school’s School Coexistence Department is informed and is working in coordination with the Municipal Education Department’s School Coexistence unit.

Villagra indicated that further updates regarding the situation would be provided starting next week.

Currently, the minors involved have not been sanctioned. The DAEM is awaiting guidance from the Superintendency of Education regarding the appropriate steps to take, given that the case involves students in basic education.

Potential Developments

  • Disciplinary Actions: Sanctions against the students may be implemented once the Superintendency of Education delivers the required guidelines.
  • Legal Proceedings: The criminal complaint could lead to further legal actions depending on the findings of the investigation.
  • Safety Measures: There may be a continued push for formal protection measures for the affected teacher as the legal process unfolds.
