Court Orders Restraining Order Between Former President Alberto Fernández and Fabiola Yáñez
In a significant turn of events, the justice system has ordered a restraining order preventing former first lady Fabiola Yáñez from having any contact with her ex-partner, former President Alberto Fernández. The measure was determined by Judge Christian Borelli following a denunciation by Fernández, accusing Yáñez of harassment, including disputes over the custody of their son, Francisco.
The resolution issued by the judge mandates that, for 90 consecutive days following notification to Yáñez, the former first lady shall not engage in any form of conversation with the former president, either directly or indirectly, with the exception of discussions related to the co-parenting of their child. Furthermore, both Yáñez and Fernández are to refrain from publicizing any information regarding the ongoing case or their son.
Alberto Fernández’s Denunciation and Accusations
Last week, the former president presented a denunciation before the City of Buenos Aires justice system against the former first lady. Aspreviewed by TN, the presentation included claims over the custody of their son, Francisco, and was supported by audio recordings that Fernández considers crucial evidence. The denunciation, made by Fernández’s lawyer, Silvina Carreira, demands the "immediate return" of the two-year-old child from Spain to Argentina, arguing that the current situation could pose a risk to the minor’s well-being.
Fernández stated that he was unable to communicate with his son during the Christmas and New Year’s holidays and alleged that he received harassing late-night calls from Yáñez. He asserted that, while he was separated from his son, Yáñez was "enjoying alcohol and fine dining" during a New Year’s Eve celebration at a Madrid restaurant.
Alberto Fernández Indicated for February 4 in Cause Related to Violence against Fabiola Yáñez
At the end of December, Judge Julián Ercolini, handling the violence against women case filed by Yáñez against Fernández, scheduled Fernández for a February 4 declaration of indagation. Ercolini had postponed this initial call after the defense sought to transfer the investigation from federal to Buenos Aires city courts. The defense of the former president had attempted three times in December alone to delay this declaration. The Federal Chamber of Buenos Aires rejected this transfer request and upheld Ercolini’s jurisdiction over the case.
