In an interview with the Polish newspaper Rzeczpospolita, Polish Deputy Foreign Minister Wladyslaw Bartoszewski asserted that Netanyahu would be detained if he attends a commemoration of the 80th anniversary of Auschwitz’s liberation in Poland next month. "Poland, as a signatory of the Rome Statute, has an obligation to follow ICC orders," he stated, as quoted by Russia Today on Saturday (28/12/2024).

Meanwhile, the Jerusalem Post reports that Israel’s Education Minister Yoav Kisch is expected to be the sole representative of the Israeli government at the Auschwitz anniversary event.

The ICC issued an arrest warrant for Netanyahu and former Israeli Defense Minister Yoav Gallant in November, accusing them of war crimes involving the deliberate use of food, water, and medical supplies as weapons against civilians in Gaza. Prosecutors maintain there was no clear military necessity for these actions, which they assert violate international humanitarian law.

While 27 EU member states are bound by the Rome Statute to enforce the ICC’s arrest warrant, reactions have been varied. Hungarian Prime Minister Viktor Orban has openly invited Netanyahu to visit. Conversely, countries like Spain, the Netherlands, Belgium, Ireland, Lithuania, and Slovenia have signalled their intent to comply with the ICC’s order, regardless of diplomatic immunity.

Initially, France indicated its intention to honor the arrest warrant, but later cited diplomatic immunity to shield Netanyahu.

Israeli officials have condemned the ICC’s actions, with Netanyahu comparing the case to the "modern-day Dreyfus affair" and asserting it has a political motivation.

In response to the potential arrest threat, Israel has not yet commented on Poland’s statement or indicated Netanyahu’s plans for the Auschwitz anniversary event. As the situation evolves, diplomatic tensions between Poland and Israel may escalate, with broader implications for the EU’s stance on the ICC’s ruling.
