Utrecht Court Rules in Favor of Asylum Seekers: Minister Faber Must Continue Bed-Bath-Food Scheme

The court in Midden-Nederland has ruled that Minister Faber of Asylum and Migration must continue the existing bed-bath-food (bed-bad-brood) scheme for 100 asylum seekers in Utrecht beyond January 1, 2025. This decision comes just days after a similar ruling in Rotterdam, where a judge ordered that 22 asylum seekers were to continue receiving the same support.

In September, Minister Faber announced that the government would no longer provide funding to municipalities for the Landelijke Vreemdelingenvoorzieningen (LVV), the official name for what is commonly known as the bed-bath-food regulation. This decision had been met with objection from the 100 asylum seekers in Utrecht who were benefiting from the scheme.

However, the court has now ruled that the interests of the asylum seekers outweigh the financial considerations of the minister. The decision, based on the argument that the asylum seekers risked becoming homeless without the support, is a significant blow to the government’s plans to scale back the scheme.

Faber has previously argued that the LVV should not be funded by the state and has indicated that asylum seekers should be accommodated in freedom-restricting facilities (VBL) in Ter Apel. However, the court has raised concerns about the legal uncertainties surrounding the VBL’s admission criteria and the availability of sufficient beds.

The judge also questioned whether Faber’s concerns were genuinely financial, or if there were other considerations at play. The court noted that costs are also associated with the VBL program, and Faber had not provided evidence that these costs were lower than those of the LVV.

In related news, a similar case is set to be heard in Amsterdam tomorrow. In Eindhoven, 27 asylum seekers have already taken their case to court, with the municipality agreeing to temporarily fund the scheme themselves.
