Investigative Body to Scrutinize Judge in High-Profile Harvey Moeis Case Amidst Public Outcry

In response to growing public unrest, the Supreme Court’s Judicial Commission (Komisi Yudisial or KY) has announced it will examine the judge presiding over the Harvey Moeis case at the Central Jakarta Corruption Court. The commission, tasked with enforcing ethical standards and conduct among judges, aims to ensure impartiality and public trust in the justice system.

KY’s spokesperson, Mukti Fajar Nur Dewata, confirmed that a thorough analysis of the complaint concerning potential misconduct by the judge is currently underway. The report, received on January 6, 2025, alleges violations of the Code of Ethics and the Judicial Conduct Ethics (KEPPH).

On December 23, 2024, the panel of judges, led by Eko Aryanto and including Suparman Nyompa, Eryusman, Jaini Basir, and Mulyono, concluded that Harvey Moeis (HM) was guilty of corruption and money laundering in the illegal trading of tin at PT Timah Tbk from 2015 to 2022. They sentenced him to 6 years and 6 months in prison, a fine of IDR 1 billion (subsidiary to 6 months imprisonment), and ordered him to pay IDR 210 billion in compensation.

However, the verdict sparked controversy, as it was deemed lenient compared to the prosecution’s demand for a 12-year sentence, a similar fine, and the same compensatory amount. Adding fuel to the fire, the judges reportedly considered Moeis’ polite demeanor and family responsibilities in their sentencing decision.

With the public’s scrutiny intensifying, KY has prioritized this case, with Mukti assuring that a meticulous inquiry will ensue. Should the analysis of the report be completed, KY may convene hearings with relevant parties and even summon those involved.

Mukti also revealed that KY maintains close coordination with other relevant institutions, such as the Attorney General’s Office, and has exchanged correspondence with President Prabowo Subianto to address various judicial challenges.

The high-profile case has also implicated other defendants, including SG as commissioner of PT SIP, RI as the CEO of PT SBS, RA as director of PT RBT’s business development, S as CEO of PT RBT, R as general manager of PT TIN, and HL, a businessman.
