Riau‘s KPU Ready to Face Seven Election Dispute Cases at Constitutional Court
Riau, Indonesia—The Provincial Election Commission (KPU) of Riau has declared its preparedness to handle seven election dispute cases submitted to the Constitutional Court (MK). These cases involve the election of local heads in seven regencies/cities.
The seven areas that have filed appeals to the MK are Kuantan Singingi Regency, Kampar Regency, Rokan Hilir Regency, Rokan Hulu Regency, Siak Regency, Dumai City, and Pekanbaru City. The disputes, according to KPU Riau Chairman Rusidi Rusdan, stem from dissatisfaction by certain pairs of candidates (paslon) with the results of the vote-counting process conducted by the KPU at the regency/city levels. Issues raised include procedural irregularities, discrepancies in vote counts, and campaign violations that potentially impacted election outcomes.
"We have ensured that all stages of the election have been carried out in accordance with the existing legal guidelines," Rusidi stated on Saturday, December 28, 2024.
KPU Riau has undertaken all procedures with high transparency and accountability, Rusidi added. "We are ready to face the dispute process initiated by parties who are not satisfied with the election results. All stages carried out by KPU have been in accordance with the regulations, and we trust that the Constitutional Court will make a fair and wise decision."
The MK has initiated the dispute process by conducting preliminary examinations. This early stage precedes the formal hearing of the appeal. The preliminary examination and correction process for plaintiff documents began on December 23, 2024, and will conclude on January 2, 2025.
Following this, MK will hold the preliminary examination from January 8 to 16, 2025, focusing on verifying the completeness and clarity of the petition material and examining and confirming the evidence submitted by the plaintiff. This will be followed by the submission of defendant responses, witnesses’ statements, and statements from the Election Supervisory Body (Bawaslu) from January 16, 2024, to February 3, 2025. The preliminary examination of hearings will then take place from January 17, 2025, to February 4, 2025.
The process will culminate in a meeting of judges on February 5 to 10, 2024, followed by the final hearing for the reading of the decision on February 11 to 13, 2025. The delivery of the copy of the decision will be conducted from March 7 to 13, 2025.
Despite facing multiple disputes, KPU Riau emphasizes its commitment to supporting fair and transparent democratic processes. It will ensure that the legal process at the Constitutional Court follows principles of justice, preventing any party from feeling aggrieved.
"The legal process is part of the democratic mechanism that must be respected by all parties. We will continue to provide information required by the Constitutional Court and are prepared to give clarifications and present evidence as needed," said Supriyanto, a member of KPU Riau’s Legal and Supervisory Division.
Supriyanto hopes that the MK will provide a decision that is best for the people of Riau, contributing to the long journey of building a better and more qualified democracy.
