Federal Safety Regulators Open Audit on Cybercab Self-Certification
Hours after an event in downtown Austin to mark the rollout, federal regulators moved quickly to scrutinize the vehicle’s unique design. The National Highway Traffic Safety Administration announced an audit query examining approximately 1,000 Cybercab vehicles to determine how the company certified that the driverless pods comply with Federal Motor Vehicle Safety Standards. Unlike most other countries, where new vehicle models and technology need regulatory clearance ahead of launch, automakers in the U.S. can deploy them on the public roads by self-certifying that they meet federal standards.
The NHTSA said it is opening an audit query to examine the process and technical data on which Tesla relied when certifying the Cybercab and related issues. Among other things, NHTSA will consider the extent to which Tesla’s certification depended on determinations that certain FMVSS are inapplicable to the Cybercab. The issue that NHTSA has with the Cybercab is that it lacks permanently attached, conventional manual controls, such as a brake pedal, gas pedal, steering wheel, and mirrors, in case something goes wrong with the car’s onboard cameras.
Industry Experts Question Compliance and Push Boundaries
Automotive safety experts and legal scholars immediately questioned whether the steering wheel-less vehicle can legally satisfy existing federal standards written for human-driven vehicles and require manual controls. Michael Brooks, executive director of the Center for Auto Safety, a consumer advocacy group, noted the regulatory mismatch.

Navigating Regulatory Gray Areas and Prior Investigations
The current audit echoes previous federal scrutiny of autonomous vehicle developers. Under the Biden administration, NHTSA also opened a similar probe into Amazon-owned Zoox after it self-certified its own driverless cars in a similar fashion. The agency ultimately closed the investigation in 2025, then allowed Zoox an exemption for testing purposes, and in July granted Zoox another exemption from FMVSS to commercially deploy its autonomous pods. It’s possible that the Tesla situation will be resolved in a similar manner, while NHTSA has begun reworking its rules to make it easier to deploy autonomous vehicles and is working on rules.

Public documents submitted to the State of Texas over the past week show that Tesla has added 45 Cybercab units to its fleet of Robotaxi-enabled cars in Austin. Tesla notified the Agency that it certified those Cybercab vehicles as compliant with all applicable Federal Motor Vehicle Safety Standards and plans to gradually expand commercial deployment of the Cybercab to include additional vehicles and locations, continuing a multi-year effort toward unsupervised ride-hailing for Tesla’s Robotaxi platform.
