Merchan also rejected Trump’s request to dismiss the case, citing last year’s Supreme Court ruling that protects Trump from prosecution for any crimes committed during his presidency.

Trump is not facing charges for the $130,000 payment made to adult film actress Stormy Daniels during his 2016 presidential campaign. The money, funneled through his then-lawyer Michael Cohen, was intended to ensure Daniels’ silence about their alleged affair. Instead, Trump was found guilty of document forgery and campaign finance law violations. Cohen pleaded guilty and served time in prison for his role in the scheme.

With the guilt phase concluded, the sentencing hearing will now focus solely on determining Trump’s punishment. The former president, who lost his re-election bid to Joe Biden, is eligible to participate in the sentencing either in-person or virtually.

Following Trump’s election defeat, several other criminal cases against him have been paused or put on hold. However, Judge Merchan’s decision signals that the legal process will proceed, albeit with some latitude given Trump’s impending presidency.
