In a second press release, the head of the presidential cabinet specifies the terms of the current affairs regime. In short, the government does not have the full exercise of power. The movement of personnel and missions outside the country are formally prohibited, unless waived by the President of the Republic.
The press release also states that “the Prime Minister, head of government, informed his Excellency (Félix Tshisekedi), President of the Republic that from this day forward, he himself and the members of his government will use the right to suspend and resume their parliamentary mandate provided for by paragraphs 2 and 3 of article 110 of the Constitution, so as not to find themselves in a case of incompatibility of functions”.
And to continue: “my choice fell on that of the mandate of national deputy to represent the constituency of Kasenga. The request to come and present myself before the President of the Republic was to inform him of my choice.”
Sama Lukonde had been preceded, the day before, by 2 of his ministers Vital Kamerhe and Jean-Pierre Lihau, elected national deputies. 3 other ministers, Peter Kazadi, Nicolas Kazadi and Puis Muabilu, also elected to the National Assembly, for their part announced their decision to remain in government. The Deputy Minister of Planning, Crispin Mbadu, was the first member of the government to give up.
“Taking into account the particular situation that the country is going through and while awaiting the formation of the new government, the Head of State asked the Prime Minister and the members of the government, each in view of their functions, to ensure the expedition current affairs in accordance with Article 6 of Order No. 22/002 of January 7, 2022 relating to the organization and functioning of the government, practical arrangements for collaboration between the President of the Republic and the Government as well as between members of the Government “, we read in a press release from Guylain Nyembo, chief of staff of the President of the Republic.
