Enefit Power asks the AGCM for compensation for damages in relation to the production price established for the universal service and the supervisory contribution awarded to Enefit through the court.
Enefit Power, a subsidiary of Eesti Energia, has gone to court in two disputes.
“The first court case concerns the temporary production price of the universal service established by the Competition Authority and the second the supervisory fee awarded to the company by the Competition Authority in relation to the universal service,” Mattias told ERR Kaiv, spokesperson for Eesti Energia.
He added that Enefit had turned to the court because, despite lengthy negotiations, it had failed to reach a common position with the Competition Authority on how to apply the current law. Since these controversial issues can have a long-term impact on the society, it was deemed necessary to seek clarification with the help of the courts.
According to Kaivu, the energy company will not provide further details on the dispute, as the proceedings are still ongoing.
Justice Minister Kalle Laanet informed the Council of Ministers on Thursday that Enefit Power has filed claims for damages against the Competition Authority in relation to the electricity producer’s obligation to sell electricity to electricity sellers at the production price and to the inspection fee agreed by the Competition Authority.
In September 2022 the Competition Authority temporarily set the production price of the universal electricity service at 15.4 cents per kilowatt hour, but Enefit Power considered that this did not cover production costs and wanted the price of production was 18.18 cents.
Last March, Eesti Energia estimated the loss suffered by Enefit Power in the fourth quarter of 2022 due to universal service at 128 million euros.
