At the same time, the KKE also sees criminal responsibilities for the alteration of the accident site, a few twenty-four hours after the incident, without however naming any persons. “Precisely because the breach of duty is also a misdemeanor with a short five-year statute of limitations, only the former Ministers K. Spirtzis and K. Karamanlis can be held criminally responsible,” states the conclusion. In fact, based on the interpretation advanced by the KKE, the Spirtzis case is not statute-barred since the time of the commission of the offense was not preceded by the Constitutional revision.
The 42 page finding which the KKE submitted to the Parliamentary Inquiry Committee noy is investigating the causes that led to the Tempe train crash a year ago, yrejects clear criminal responsibilities to the Ministers of Transport of the period 2009 – 2023.

  • for the felony offense of negligently disrupting the safety of rail traffic which resulted in the death of 57 people.
  • for the felony offense of fatal exposure, because the Ministers were aware of the deficiencies and gaps in the safety issues of the rail network, which are causally linked, both to the accident in question.
  • the offense of dereliction of duty, since the competent Ministers of Infrastructure and Transport who had the supervision of OSE and ERGOSE, deliberately failed to supervise the way these projects were commissioned in order to serve the big business giants.
