Merko Ehitus is in trouble with the Latvian Competition Council, the company risks a large fine

The basis for the Competition Council’s decision was a significant part of the transcripts of the conversations, which came from the wiretap recordings carried out by the Latvian Bureau for Prevention and Combating of Corruption (KNAB). According to the decision of the Latvian Competition Council, on 06.27.2016 the then manager of SIA Merks participated in a meeting of Latvian construction companies. According to the decision of the Latvian Competition Council, a total of 12 such meetings were held, the others were not attended by the representative of SIA Merks, Merko Ehitus announced on the stock exchange.

SIA Merks has not been charged with a cartel in Latvia. Unlike Estonia, in Latvia possible violations of competition law are dealt with in administrative proceedings, where the Competition Council is both the investigator and decision-maker. The accused company can appeal the decision to the administrative court, but unlike criminal proceedings, the burden of proof is reversed, i.e. the company must prove that it is not guilty.
