The Biden administration recently took a significant step towards implementing stricter regulations on firearm sales. The finalized rule, aimed at closing what gun control advocates call the “gun show loophole,” requires individuals selling firearms online or at gun shows to conduct thorough background checks on potential customers.

By more precisely defining what it means to be “engaged in the business” of selling firearms, the Justice Department intends to increase compliance with federal background check requirements and better regulate the market.

“Under this regulation, it will not matter if guns are sold on the internet, at a gun show, or at a brick-and-mortar store: if you sell guns predominantly to earn a profit, you must be licensed, and you must conduct background checks,” Attorney General Merrick Garland stated.
