The intermediary hid the incidental costs of the rented apartment. Consumer Protection ordered the return of the commission to the customer

At the end of May this year, the consumer went to view an apartment for rent with an intermediary, because its price, 400 euros per month, suited him. However, after signing the rental agreement, it turned out that additional costs had been added to the rent, which the client did not like and which the intermediary had not told the client about.

The customer had paid the intermediary 400 euros, but since the rental contract was not concluded precisely because the intermediary did not inform the customer of the additional commissions, the customer wanted the intermediary’s fee back. The customer appealed to the Consumer Disputes Commission.

The brokerage firm Eesti Seenekasvatuse OÜ did not respond to the Consumer Disputes Committee.

The Consumer Disputes Commission looked into the matter and found that in this case there was a significant error on the part of the broker, as the customer was given the impression that the hearing costs were low. Furthermore, the broker did not present the corresponding invoices to the client. Furthermore, the broker pressured the client to quickly decide and sign the contract. However, later, after paying the brokerage commission, it was discovered that the incidental costs exceeded the client’s reasonable expectations and, had he been aware of this, he would not have signed the rental contract.

The Consumer Disputes Committee decided that Eesti Seenekasvatuse OÜ must return 400 euros to the customer.

Delfi also reached out to the company, but did not receive a response to a request for comment.

Eesti Seenekasvatuse OÜ is a Võru company founded in 2015. The main activity of the company is the business of real estate agencies. The company has one employee and the taxable turnover in the third quarter of this year was 19,125 euros.

In 2022, the private company’s turnover was 64,506 euros, which is almost 60% more than in the previous year. If in 2021 the company’s loss was 5,424 euros, last year it remained positive with 18,194 euros.
