“The risk of violence is high and he inspires others. He will therefore have to serve his sentence under strict security measures,” government lawyer Andreas Hjetland said on the last day of the five-day hearing. “There is simply no indication that Breivik’s human rights were violated,” Hjetland added.
Breivik claims in his lawsuit that the solitary confinement he was placed in amounts to inhumane punishment under the European Convention on Human Rights. This is the second such complaint he has filed and both have been rejected.
Breivik’s lawyer, Øystein Storrvik, said Thursday that his client was affected by his lack of contact with the world around him.
In his testimony on Tuesday, Breivik cried and said he suffered from depression and suicidal thoughts. A prison psychiatrist who has met Breivik since 2022 expressed doubts.
“I’ve never seen him like this before, I’ve never seen him cry or show any emotion. It was a reaction I didn’t expect,” said Janne Gudim Hermansen. “It may have been his way of showing his desperation, but I’m not sure how believable it was. I think maybe it was used to gain something,” he said. added.
Breivik was sentenced to a maximum of 21 years in prison under a rarely used provision in Norway’s legal system that allows him to be imprisoned indefinitely if he is still considered a danger to society.
In 2011, Breivik killed 77 people in a bomb and gun attack. He did not regret his attacks, which he described as a crusade against multiculturalism in Norway.
He applied for parole in 2022, but the court said he showed no signs of rehabilitation.
